These General Terms of Service and Sale govern the use of the Oweeps website, as well as orders placed through our online store.

In these Terms, the terms “Oweeps,” “we,” “our,” and “us” refer to OWEEPS COMMERCE LLC. The terms “customer,” “you,” and “your” refer to any person who visits the website or places an order.

By accessing our website, using our services, or making a purchase, you agree to these Terms as well as our other policies available on the store.

1. Purpose of the Terms

These Terms govern, in particular:

• the use of the Oweeps website;

• the presentation and sale of our products;

• the creation and acceptance of orders;

• prices and payments;

• delivery;

• returns and refunds;

• the respective obligations of Oweeps and its customers.

They must be read together with:

• our Shipping Policy;

• our Return and Refund Policy;

• our Privacy Policy;

• any other policy published on our store.

In the event of a conflict, mandatory rights granted to consumers under applicable federal, provincial, or territorial laws prevail.

2. Website terms of use

By using our website, you confirm that you:

• have reached the age of majority in your province, territory, or country of residence;

• have the legal capacity required to enter into a contract;

• use the website only for lawful purposes;

• provide accurate, complete, and up-to-date information.

You must not use our website or our products to violate any law, commit fraud, infringe the rights of a third party, or disrupt the operation of the store.

3. Product information

We make every effort to accurately present the features, dimensions, materials, colors, and functions of our products.

However:

• colors may vary slightly depending on the screen used;

• the appearance of the packaging may change;

• minor changes may be made by the manufacturer without altering the product's main function;

• photographs are provided for illustrative purposes.

The stated dimensions, capacities, temperatures, and heat-retention times are based on information provided by the manufacturer or on normal conditions of use. Actual performance may vary depending on the beverage's initial temperature, how often the mug is opened, the ambient temperature, and the conditions of use.

4. Use of the ThermoSmart™ mug

The ThermoSmart™ mug must be used in accordance with the instructions provided on the website or with the product.

In particular, the customer must:

• check the temperature before drinking;

• properly close the lid before transport;

• keep the product out of reach of young children when it contains a hot liquid;

• not place the mug in a microwave oven;

• avoid immersing the electronic lid for extended periods;

• follow the cleaning and care instructions.

The digital display provides an approximate temperature. It is not a medical, scientific, or laboratory instrument.

Oweeps cannot be held liable for damage resulting from clearly improper use, a fall, an impact, modification of the product, or failure to follow the instructions, subject to the mandatory protections provided by law.

5. Prices

Prices are displayed in the currency indicated on the store, generally in U.S. dollars for customers located in Canada and the USA.

The applicable price is the price displayed when the order is placed.

Standard shipping is free for orders delivered in the United States and Canada.

Before confirming payment, the customer can review:

• the price of the products;

• applicable discounts;

• taxes calculated at checkout;

• the total amount of the order.

No undisclosed mandatory fixed fees will be added after the order. 

6. Taxes, duties, and import fees

For deliveries to the United States and Canada, Oweeps uses shipping methods intended to include or cover:

• shipping costs;

• customs duties;

• import taxes;

• applicable brokerage or customs clearance fees.

Our goal is for the amount displayed and paid when placing the order to be the final amount owed by the customer.

Normally, no cash or card payment should be made to the carrier at the time of delivery.

If a carrier exceptionally requests an unexpected payment, the customer must contact Oweeps immediately at:

If the customer is required to pay the requested amount in order to receive the package, they must provide their order number, the carrier’s payment notice, and proof of payment. After verification, Oweeps will reimburse the justified amount using the original payment method or another method agreed upon with the customer.

7. Orders

To place an order, the customer must provide the requested information, including:

• their full name;

• their email address;

• their billing address;

• their shipping address;

• a valid telephone number where necessary;

• their payment information.

The customer must verify the accuracy of this information before confirming the order.

After payment, a confirmation email is sent to the address provided. This message normally summarizes the products ordered, the amount paid, the shipping address, and the order number.

For distance contracts entered into in Quebec, certain information must be disclosed before the order, and a written copy of the contract must be sent to the consumer. These rules may apply even when the merchant is located outside Quebec. 

8. Order acceptance

Receipt of an order or payment does not necessarily mean that the order has already been shipped.

Oweeps may verify the order before processing it.

We may refuse or cancel an order, particularly in the event of:

• a declined or unauthorized payment;

• reasonable suspicion of fraud;

• clearly incorrect information;

• product unavailability;

• an obvious pricing or description error;

• an unusually large quantity intended for unauthorized resale;

• an inability to deliver to the address provided.

When a paid order is canceled by Oweeps, the corresponding amounts are refunded to the original payment method, unless otherwise required by law.

9. Product availability

Products are offered subject to availability.

An out-of-stock situation may exceptionally occur after an order has been confirmed, particularly because of a discrepancy between the displayed inventory and that of the logistics partner.

In this case, Oweeps may:

• offer an additional delay;

• offer an equivalent product with the customer's consent;

• cancel the unavailable item and issue a refund.

No replacement product will be imposed on the customer without their consent.

10. Payment

Accepted payment methods are displayed at checkout.

By providing payment information, the customer confirms that they:

• are authorized to use the selected payment method;

• have provided accurate information;

• authorize the charge of the total amount displayed.

Payments may be processed by Shopify or independent payment service providers. Oweeps does not necessarily receive all of the customer's banking information.

An order may be suspended or canceled if the payment is declined, disputed, or flagged as potentially fraudulent.

11. Promotional codes and discounts

Promotional codes are subject to the conditions specified when they are published.

Unless otherwise indicated:

• only one promotional code may be used per order;

• codes cannot be exchanged for cash;

• they cannot be applied retroactively;

• they may have a limited validity period;

• certain offers may be limited to specific products or territories.

Oweeps may cancel a discount obtained through fraud, misappropriation, or misuse.

12. Processing and delivery

Orders are generally processed within:

up to 3 business days

After shipment, the estimated delivery time to the United States and Canada is generally:

14 to 18 business days

The total estimated time is therefore usually:

17 to 21 business days

These time frames are estimates and may vary depending on the destination, customs inspections, weather conditions, busy periods, or logistics disruptions.

13. Order transfer and tracking

Oweeps works with suppliers, fulfillment centers, and partner carriers.

An order may be prepared or shipped from a country different from the customer's country of residence.

The supplier may receive the information strictly necessary to fulfill the order, such as:

• the recipient's name;

• the shipping address;

• the telephone number;

• details of the product ordered.

This transfer is carried out in accordance with our Privacy Policy.

When a tracking number is available, it is sent to the customer by email.

Customers may follow the progress of their shipment through our Track My Order page.

14. Shipping address

The customer is responsible for the accuracy of the address provided.

Any request for a change must be sent promptly to:

We will do our best to make the correction before shipment, but no change can be guaranteed after the order has been forwarded to the supplier or carrier.

Reshipping fees may be requested when a package is returned because of an incorrect or incomplete address provided by the customer, to the extent permitted by law.

15. Risk of loss and delivery issues

Oweeps remains responsible for fulfilling the order in accordance with applicable laws and the commitments published on the store.

In the event of a lost, damaged, or undelivered package, the customer must contact our customer service and provide their order number.

An investigation may be opened with the carrier before a reshipment or refund is issued.

The customer must keep photographs of the package, label, and product when the product arrives damaged.

16. Returns, exchanges, and refunds

The conditions for returns, exchanges, and refunds are described in our Return and Refund Policy.

The customer must review this policy before placing an order.

Oweeps offers a free standard return for eligible products when the request is submitted within 15 calendar days after delivery. Prior authorization is required so that Oweeps can provide a prepaid return label or other written return instructions.

Once an approved return has been received and inspected, the refund is generally initiated within 5 to 10 business days using the original payment method. The customer’s bank or payment provider may require additional processing time.

It specifies, in particular:

• the time limit for requesting a return;

• eligibility conditions;

• products that cannot be returned solely because of a change of mind;

• the handling of defective or damaged products;

• return shipping costs;

• refund time frames and methods.

In Canada, there is no general and uniform right to return any product solely because the customer has changed their mind. The seller's stated policy and applicable provincial protections must be respected. (ISED Canada)

17. Warranties and legal rights

Products sold by Oweeps remain subject to the mandatory warranties and protections provided by applicable laws.

Nothing in these Terms is intended to unlawfully eliminate or limit the consumer's remedies when the product is:

• defective;

• dangerous;

• not as described;

• unfit for its normal purpose;

• different from the product ordered.

Where an exclusion or limitation contained in these Terms is incompatible with a mandatory rule, that exclusion or limitation does not apply.

18. Intellectual property

All content on the Oweeps website is protected, including:

• the Oweeps name;

• the ThermoSmart™ name;

• logos;

• text;

• images;

• videos;

• illustrations;

• graphic elements;

• the store design.

Unless written permission has been granted, it is prohibited to copy, reproduce, modify, publish, resell, or commercially exploit these elements.

Purchasing a product does not grant any ownership rights in the brand or the store's content.

19. Reviews and content submitted by customers

When you publish a review, photograph, comment, or testimonial, you confirm that you:

• are the author of the content or are authorized to use it;

• do not infringe the rights of a third party;

• do not publish content that is false, illegal, discriminatory, threatening, or defamatory.

You authorize Oweeps to display and reproduce this content for the purposes of presentation, promotion, or improvement of its services, without unnecessarily disclosing your personal information.

Oweeps may remove any content that violates these Terms or applicable laws.

20. Prohibited uses

In particular, it is prohibited to:

• use the website for fraudulent purposes;

• attempt to gain unauthorized access to the website;

• introduce a virus or malicious code;

• collect the personal data of other users;

• impersonate any person;

• circumvent security systems;

• copy or resell website content;

• place fraudulent orders;

• misuse promotions or refund procedures.

Oweeps may suspend access to the website or cancel an order in the event of misuse, subject to refunding any amounts that must legally be refunded.

21. Third-party links and services

Our store may contain links to services, applications, or websites operated by third parties.

These services may include:

• payment;

• package tracking;

• social media;

• customer reviews;

• marketing tools.

Oweeps does not control all of the content or practices of these third-party websites.

The customer must review their respective terms and policies before providing them with information or using their services.

23. Website accuracy

We strive to keep the information on the website up to date.

However, typographical, technical, or display errors may exceptionally occur regarding:

• a description;

• a price;

• a discount;

• availability;

• a time frame;

• a photograph.

When a material error is identified after an order is placed, we will contact the customer to offer a correction, an equivalent solution, or a cancellation with a refund.

24. Limitation of liability

To the extent permitted by law, Oweeps cannot be held liable for indirect or unforeseeable damages arising, in particular, from:

• a temporary interruption of the website;

• use of the product contrary to its intended purpose;

• incorrect information provided by the customer;

• an event reasonably beyond our control.

Where our liability may legally be limited, it will not exceed the amount paid for the order concerned.

This limitation does not apply where prohibited by law, including in cases of intentional misconduct, gross negligence, bodily injury, or a mandatory consumer right.

25. Events beyond our control

Oweeps will not be considered to have failed to meet its obligations where a delay or inability to perform results from an event reasonably beyond its control, including:

• a natural disaster;

• extreme weather conditions;

• a strike;

• a border closure;

• a major transportation disruption;

• a public health crisis;

• an administrative or customs decision;

• a widespread outage affecting an essential service provider.

We will inform the customer when such an event materially affects their order and will seek an appropriate solution.

26. Changes to the Terms

Oweeps may amend these Terms to reflect:

• changes to its services;

• legal or regulatory changes;

• a change of supplier or service provider;

• an improvement to the operation of the store.

The version applicable to an order is the version that was published when that order was placed.

The date of the latest update is indicated at the top of the document.

27. Severability

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will continue in effect.

The provision concerned will be interpreted or replaced to the extent necessary to comply with applicable law and preserve its original purpose as far as possible.

28. No waiver

Oweeps' failure to immediately exercise a right provided under these Terms does not constitute a permanent waiver of that right.

Any waiver must be clear and comply with applicable law.

29. Governing law

These Terms are governed by the laws applicable to OWEEPS COMMERCE LLC, organized in the United States, as well as by the mandatory laws applicable in the consumer's province or territory of residence.

For Canadian consumers, nothing in these Terms deprives them of the mandatory protections provided by federal, provincial, or territorial laws.

30. Dispute resolution

In the event of a problem, the customer is invited to contact Oweeps to seek an amicable solution:

Where possible, the request should include:

• the customer's name;

• the order number;

• a description of the problem;

• any useful documents or photographs.

If no amicable solution is found, each party retains the right to contact the appropriate consumer protection authority or court in accordance with applicable law.

31. Entire agreement

These Terms, together with the policies to which they refer, constitute the agreement between Oweeps and the customer regarding the use of the store and orders placed.

They replace any previous statement concerning the same subject matter, except for a written commitment expressly accepted by Oweeps.
